Terms and Conditions

The following Terms and Conditions of Use and Service [“T & C”] are effective as of date.

APPLICABILITY

The following T & C is a contract between you and PerfectSuvidha Private Limited [“We”/ “Us”/ “Our”]; and sets out our respective rights and obligations. You are deemed to have accepted the T & C when you do any, or all of the following:

  • click on the box next to“I have read, understood and accept the above T & C and the Privacy Policy therein” wherever indicated on this website;

  • access/ browse through this website;

  • interact with Us over electronic or digital modes of communication.

DEFINITIONS

“Agreement”- The word “Agreement” is used occasionally and interchangeably with “T & C” hereinafter to refer to this Terms and Conditions of Use and Service (and its future revised versions) and the privacy policy (and its future revised versions) therein.

“Dispute”- Any claim including claims relating to the T & C, any supplemental/ addendum clauses to the T & C, future revised versions of the T & C, or any other aspect of the T & C.

“Parties”- The word “Parties” is used to refer to you and Us, together.

“Refund Policy”- The refund policy which is applicable to this Agreement and may be found hereinbelow.

“Services”- Means the following services (including any other services incidental to the ones listed below) offered by Us, details of which can be found in the dropdown menu under the “Services” tab appearing on our website:

  • Issue of Learning License and Driving License

  • Renewal of Driving License (after or before expiry of the same)

  • Duplicate Driving License

  • Issue of Auto/Taxi/Bus/Conductor Badge

  • Change of Address/Name/Date of Birth on the Driving License

  • Obtaining No Objection Certificate for a Driving License

  • Issue of International Driving License

  • Transfer of Ownership of Vehicle

  • Payment of Road Tax for Vehicle

  • Re-registration of Vehicle

  • Termination of Hypothecation from Vehicle Registration

  • Obtaining No Objection Certificate for a Vehicle

“Website”- Means the website found at URL www.rtosuvidha.com


REPRESENTATIONS AND WARRANTIES BY US

We represent that

  • We are a private limited company engaged in the business of providing Services;

  • We own and operate inter alia through Our registered brand-name “RTO Suvidha”

  • We are not associated in any manner with any Regional Transport Office anywhere within India or outside India and/ or the Roads and Transport ministry at any level within India or outside India and / or any road transport authority within India or outside India.

We warrant that

  • We follow the privacy practices and standards as mentioned in this Privacy Policy add link which forms part of this Agreement;

  • You own the rights to all information, image content and data (including your photographs, documents, PAN card, Aadhar card) you provide to Us and that we do not and shall not claim ownership over any such information.


REPRESENTATIONS AND WARRANTIES BY YOU

You represent that

  • you are 18 years or above;

  • you have read and understood the T & C before accepting the same by clicking on the “Accept” button on this page.

You warrant that

  • you will provide true, correct and up-to-date information to Us at all times, including for log-in purposes; in any application and/ or forms and/ or documents whenever presented with them at any point in time on this Website and/ or by any other medium by Us for the purpose of providing you Service(s). We will not be responsible for the consequences of incorrect or inaccurate information provided by you;

  • you will not use the Website and/ or Our Services for any unlawful purposes or acts; to upload or transmit, in any way, any material that is obscene, offensive, blasphemous, pornographic, threatening, menacing, harmful, an invasion of privacy or public rights, defamatory, libelous, vulgar, illegal or otherwise objectionable; to use content (including trademarks, web design, applications, forms, documents etc.) provided by Us on the Website (or otherwise) in a way that infringes any copyright, trademark, or other intellectual property right or facilitate the unlawful distribution of copyrighted content;

  • you will not share your log-in details (of the account you hold with Us) or application number and/ or let anyone access your data to modify or do anything that might put your privacy and/ or application at risk; attempt to gain unauthorized access to or impair any aspect of the Website’s functions or its related systems or networks; attempt to probe, scan, test or violate the security features of our Website or of any associated system or network or to obtain unauthorized access to materials (including applications, forms, documents made available by Us) or other information stored thereon;

  • encourage or help anyone do any of the acts listed hereinabove.

CHANGES TO THIS AGREEMENT

We reserve the right to revise the T & C by modifying/ amending the T & C at Our sole discretion from time to time, without providing you with any notice. All such changes to the T & C shall be effective upon the revised T & C being posted on the Website. You agree to be bound by all such future revised versions of the T & C when you continue to use Our Website and/ or Services or when you use Our Website and/ or Services after any such revised version is posted on the Website. Therefore, it is important that you review the T & C regularly to ensure you keep yourself updated on any modifications/ amendments to the T & C.


INTELLECTUAL PROPERTY

  • Your use of the Website and/ or Our Services does not grant you any right, title or interest in our copyrights, trademarks or any other intellectual property rights owned by Us.

  • Our trademark for the brand name ‘RTO Suvidha’ may not be used in connection with any product or service that is not provided by Us and/ or in any manner that is likely to cause confusion among other users of the Website or in a manner that tarnishes, dilutes, disparages or discredits Us and/ or Our Services.

  • Your rights to review and edit information you provide Us or fill in as part of any application process on this Website (including log-in procedure) does not grant you any right in Our intellectual property rights.

PAYMENT TERMS AND COMMERCIAL UNDERSTANDING

You agree to make full payment of fees associated with the Service(s) you seek from Us.

If, for any reason, your payment is not received by Us, your application in relation to the Service(s) will be kept on hold till the time payment is received by Us.

We shall be entitled to levy interest @ 18% per annum on any delayed payments.

ENTIRE AGREEMENT

The T & C (and its future revised versions) along with the Privacy Policy (and its future revised versions) form the entirety of the contractual relationship between you and Us.

LIMITATION OF LIABILITY

Any remedy or right you may have against Us for any claims, demands or disputes arising out of Our Services or your use of Our Website shall be limited to the amount you may have paid as fees to Us during the six-month period immediately preceding such claims, demands or disputes raised by you.

We shall not be responsible for consequential (including claims of loss of profit), punitive and/ or incidental damages of any kind whether or not you may have informed Us of the possibility of the same.

You are solely responsible for making and/ or keeping back-up documents or original documents, as the case may be, that we may require of you as part of rendering Services or ascertaining your identity and we shall not be liable for the loss of or damage to any such document.

INDEMNITY

You agree to indemnify and hold harmless Us and/ or Our directors, employees, sub-contractors, agents, partners, affiliates and subsidiaries against/ from any claim, disputes, demands (including legal expenses) made by any third party arising from your

  • failure to provide correct and/ or accurate information;

  • violation of third-party’s rights (including but not limited to privacy rights and intellectual property rights);

  • wrongful or illegal use of the Website and/ or Our Services;

  • violation of any applicable laws through the wrongful or illegal use of the Website and/ or Our Services. This clause will survive the termination of this Agreement.

SEVERABILITY

If any of the clauses in the T & C is found to be unenforceable or invalid under the applicable laws, We may remove and/ or change the same in order to better reflect the applicable law and the remaining clauses of the T & C shall remain in force.

TERMINATION OF AGREEMENT

You agree that We may at any time, and at Our sole discretion, terminate your registered account with Us/ Our Website and/ or any application made through Us without prior notice to you and without reimbursement if we suspect a violation of any of the clauses of the T & C by you.

APPLICABLE LAW AND JURISDICTION

The T & C are governed by and will be construed in accordance with the laws of India. Any disputes arising under or in connection with the T & C shall be subject to the jurisdiction of the courts in Thane, Maharashtra.

GRIEVANCE REDRESSAL

In case of any complaints and queries in relation to Our Services or the T & C or the Privacy Policy, please write to “Grievance Officer” at grievance.officer@rtosuvidha.com. We will endeavour to redress your complaints and/ or answer queries as expeditiously as possible and, in any case, within a maximum time period of one month from the date of you raising the same upon Us in writing. Please note that you will receive an acknowledgment email/ SMS message from Us upon receipt of your complaint or query.

REFUND POLICY

We will issue a full refund of the amount paid by you if you:

  • Withdraw (by writing to Us at hi@rtosuvidha.com) your application/ request for Services within 24 hours from the time you submit the same to Us over any medium provided your application is not submitted to the relevant authorities.

We will issue a refund of 75% of the amount paid by you if you:

  • Withdraw (by writing to Us at hi@rtosuvidha.com) your application/ request for Services within 72 hours from the time you submit the same to Us over any medium provided your application is not submitted to the relevant authorities.

We will issue a refund of 50% of the amount paid by you if you:

  • Withdraw (by writing to Us at hi@rtosuvidha.com) your application/ request for Services within 5 days from the time you submit the same to Us over any medium provided your application is not submitted to the relevant authorities.

  • No refund will be issued if you withdraw your application / request for Services after the expiration of 5 days from the time you submit the same to Us or once We submit your application (in relation to the Services sought by you) to the relevant authorities, whichever is earlier.

DISPUTE RESOLUTION

Either party is required to notify the other of Dispute(s), and in the event that the same cannot be resolved through negotiation and/ or mediation, Parties agree that the same shall be resolved through arbitration conducted in India as per Indian laws by a sole arbitrator. The arbitration shall be held in Thane, India.
